Notice of Settlement
 

In 2001 the UUWA and a group of named members filed an Originating Notice of Motion in the Court of Queen’s Bench of Alberta. That legal action was seeking declarations that the Fund of the TransAlta Pension Plan was for the exclusive benefit of the participants and their beneficiaries and that TransAlta’s use of the fund to cover such things as company contributions and administrative costs was contrary to the Plan.

Following a number of appearances and applications in the Court of Queen’s Bench, Alberta Court of Appeal and the Supreme Court of Canada, we were faced with proceeding through the courts by way of trial if we wished to pursue the matter.

The pension matter was discussed, with our legal counsel in attendance, at the 2006 UUWA Annual General Meeting. Members in attendance at the meeting passed the following motion: That we cease any further legal action with regards to the current pension lawsuit; without forfeiting the rights of any individual member to pursue any separate action(s).

In February 2007 the UUWA carried out that motion by way of a written Release with TransAlta.
